Terms & Conditions

This document contains the terms and conditions of the services provided by ZANTUAR (hereinafter, the "Terms and Conditions", or the "T&C"), which are available on our website; the Terms and Conditions are the contract that ZANTUAR has with guests, which the latter accept when making a reservation to stay in our property.

Introduction

We welcome you and thank you for choosing ZANTUAR for your stay in the beautiful state of Oaxaca, Mexico. By making a reservation on our website, through any other platform operated by third parties, or by staying at our facilities, you (hereinafter, the "Guest", or the "Guests") agree to be legally bound by these Terms and Conditions, which constitute the agreement between the Guest and ZANTUAR (hereinafter, "ZANTUAR"). This document is subject to and shall be interpreted in accordance with the applicable legislation in force in the state of Oaxaca and, where applicable, the corresponding Mexican legislation. It is important to note that there may be additional terms and conditions on third-party platforms, which would also apply to the guests' stay at ZANTUAR. These terms may be directly related to the property or specific to the third-party platform in question.

It is the Guests' responsibility to review and adhere to the additional provisions during their stay at our facilities, as well as for the period specified in such terms.

Acceptance of Terms

The Guest expresses their consent to adhere to these Terms and Conditions, whether by handwritten signature or by other means, such as indicating "I Accept" in the corresponding box through digital or technological means.

These Terms and Conditions are exclusively applicable to the agreement between the Guest and ZANTUAR, regulating the mutual obligations during the provision of services.

Applicable Legislation and Jurisdiction

The activities within the premises of ZANTUAR are strictly governed by the applicable and current legislation of the state of Oaxaca, Mexico. In the event of any dispute related to this agreement, the parties will submit to the exclusive jurisdiction of the competent courts of the state of Oaxaca, waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles or for any other cause.

Guest Registration

It is imperative that all Guests provide truthful and up-to-date information at the time of making their reservation & Check-In. ZANTUAR reserves the right to deny access to the facilities to anyone who has provided false and/or incomplete information, without this giving rise to any compensation or refund whatsoever. Therefore, by this means, the Guest unilaterally and irrevocably waives the right to take any legal action against ZANTUAR, related to the refusal of ZANTUAR's service provision due to providing false or misleading information. In addition, ZANTUAR reserves the right to inform the corresponding authorities about any irregularity. It is ZANTUAR's policy to refuse accommodation to any individual who does not meet the required identification standards or who refuses to accept the Terms and Conditions established herein.

The minimum age required to stay is 18 years. Minors of this age must be accompanied by their parents, legal guardians, or a responsible adult who will take charge of them during their stay. In case a minor provides false information in order to stay without the supervision of a responsible adult, ZANTUAR will deny the provision of services to such minor.

Reservation and Payment Policies

Below, a series of concepts that will be used throughout this document are defined, therefore, each time such a concept is used in these Terms and Conditions, they will be understood by virtue of the definitions established herein:

Reservation or Reservations: Confirmation of reservations will be made through the payment of a deposit or full payment in advance, as specified at the time of making the reservation. In case of receiving a full discount on the stay, the reservation will be considered once it has been registered in our internal property management system.

Method of Payment or Methods of Payment: We accept a variety of payment methods, including credit cards, debit cards, bank transfers, and online payment platforms. Specific details regarding payment methods will be provided during the reservation process.

The guest may only stay at ZANTUAR for the period of time that has been previously booked, and must comply with the check-in and check-out times established at the time of their reservation or those that ZANTUAR communicates to them later via email or another official means directly linked to ZANTUAR.

Modifications: Modifications to reservation dates or room types are subject to availability and are subject to the same policies as cancellations, potentially incurring additional costs.

Cancellation and Refund Policy

This Policy will only apply to reservations that have been made through our website https://zantuar.hostify.club/. For other reservation platforms, this Policy may vary and it is possible that the same guidelines mentioned below may not be applicable.

At ZANTUAR, we are committed to offering flexibility and understanding towards the needs of our Guests. With this goal in mind, the following cancellation policy is established to ensure clarity and fairness in the process of cancelling and refunding reservations:

Cancellation without Penalty up to 30 Days Before: Guests have the freedom to cancel their reservation up to 30 days before the scheduled arrival date, without incurring any penalty. This policy allows for a full refund of the amount paid, offering maximum flexibility for plan changes.

Partial Refund Cancellation between 29 and 15 Days: For cancellations made between 29 and 15 days before the arrival date, a 50% refund of the total paid will be offered. We understand that plans can change and wish to provide a solution that represents a balance between flexibility for our guests and the operability of our establishment.

Cancellations Within 14 Days Prior: It is crucial to note that no refunds will be granted for cancellations made 14 days or less before the scheduled arrival date. This condition is due to the limited opportunity we have to reassign the rooms to new guests in such a short time interval.

Procedure for Cancellations:

To initiate the cancellation process, we urge our guests to contact our team directly using the means of communication specified in their reservation confirmation. It is necessary to provide the full name and reservation details to proceed effectively.

For reservations made directly with us, the refund process can take between 5 and 10 business days. This period is necessary to complete the refund procedure through third-party platforms.

In the case of reservations made through third-party platforms such as Airbnb, refunds will be subject to the specific policies of each platform. We recommend guests review these policies carefully at the time of booking to have full clarity on the cancellation and refund processes.

ZANTUAR reserves the right to modify, suspend, or cancel any reservation due to unforeseen circumstances, due to force majeure or fortuitous case.

 

Rights and Obligations of the Guest

All Guests are expected to maintain appropriate and respectful behavior towards other guests and towards the staff of ZANTUAR. Any form of behavior considered inappropriate by the management of ZANTUAR may result in expulsion from the same without the right to a refund. Guests will be financially, economically, and monetarily responsible for any damage they cause to the facilities or property of ZANTUAR, unless the damage is a direct result of negligence or fault on the part of ZANTUAR.

Rules for Guests within ZANTUAR

Room and Towel Cleaning Management:

Room cleaning will only be carried out upon explicit request from the guest, using the door signs provided to indicate this need before 11 A.M. In the case of towels, their change must be expressly requested verbally to the cleaning team or through direct contact with the person in charge of ZANTUAR.

The striped towels are for exclusive use in the pool, and the white ones for exclusive use within the room. We promote the reuse of towels to contribute to environmental care.

 

Maintaining a Quiet Environment:

During the day, the volume of the music will be kept at levels that are not annoying, in accordance with the criterion of the staff of ZANTUAR, so, in the event that employees of ZANTUAR indicate to the Guest or Guests in question of such annoyance, the latter must comply with the ordered command. From 10 P.M. to 8 A.M., ZANTUAR will prioritize maintaining an environment of silence and tranquility to promote restful sleep.

Use of Shared Areas:

ZANTUAR encourages respect and harmonious coexistence in shared areas. Guests should avoid disruptive behaviors in the pool, as well as jumping and the consumption of alcohol, in order not to alter the tranquility and safety of other guests.

 

Balcony Regulations:

 

To maintain the visual harmony of the establishment, hanging clothes on the balconies is prohibited.

Use of the Bar Area:

This space is intended for the enjoyment of the Guests, who must pick up and clean the bar area after using it.

Conservation of Hot Water:

 

We urge guests to take short showers to ensure its availability for all Guests, equally, in relation to our sustainable practices.

 

Prohibition of Narcotics:

The consumption or possession of narcotics within the premises of ZANTUAR is strictly prohibited, thus ensuring a safe and healthy environment. In the same sense, the possession of narcotics or substances prohibited by the current Mexican regulation will be notified to the competent authorities.

Smoking:​

 

Smoking is strictly prohibited in all guest rooms. It is permitted exclusively in designated outdoor common areas to ensure the comfort and well-being of all our guests.

Zero Tolerance for Fights or Violent Behavior:

 

Fights, quarrels, violent behavior, or aggressive conduct within the premises of ZANTUAR will not be tolerated. In the event of any conflict, the staff of ZANTUAR will promptly intervene to resolve the situation, prioritizing the safety and well-being of our Guests.

Respect towards the Staff:

 

ZANTUAR requires that all Guests treat the staff of ZANTUAR with respect and integrity. Any abuse or disrespectful behavior will be grounds for corrective and/or sanctioning actions.

 

Room Occupancy Policy:

 

The number of Guests per room must not exceed the limit established in the corresponding reservation, thus ensuring the safety and comfort of all. Likewise, Guests may not bring additional guests to those established in their reservation to the facilities of ZANTUAR.

Pool Hours and Use Restrictions:

 

The pool will be closed between 10 P.M. and 8 A.M. in order to guarantee the rest of the Guests. During maintenance periods, announced in advance, the pool will remain closed for use for 24 hours to make necessary adjustments in chlorine levels and general cleaning.

Security and Privacy

Personal Security: Although ZANTUAR implements security measures to protect our Guests, it is the responsibility of each individual to take care of their personal belongings. ZANTUAR will not assume any responsibility for the loss, theft, or damage of personal items within the facilities.

Data Privacy: The personal data collected during the reservation process by ZANTUAR will be handled in accordance with our Data Privacy Policies.

Facilities and Services

The service hours, including those for check-in, check-out, cleaning, and other services of ZANTUAR, will be communicated upon arrival and are subject to changes without prior notice. ZANTUAR reserves the right to modify, suspend, or cancel any service offered due to unforeseen circumstances, due to force majeure or fortuitous case.

Disclaimer

ZANTUAR shall not be liable for interruptions or failures in the services caused by fortuitous events or force majeure, including, but not limited to, natural disasters, strikes, civil conflicts, government decisions, pandemics, or any other circumstance beyond our reasonable control. Furthermore, ZANTUAR will not assume liability for damages suffered by the Guest due to actions or negligence of third parties not related to the operation of ZANTUAR, nor for damages caused to the Guest within our premises that occur without fault attributable to ZANTUAR or derived from isolated or accidental situations.

In the event that a guest suffers any damage directly related to the operation of our facilities, it is our duty and commitment to offer assistance and take the necessary measures to safeguard their well-being and resolve the problem as quickly as possible. Likewise, ZANTUAR is exempt from any liability for damages arising from natural disasters, reaffirming our commitment to the safety and well-being of our guests, while recognizing the limitations in situations beyond our direct control.

 

Security Camera Use Policy

To ensure the safety of our Guests and the staff of ZANTUAR, this porperty is equipped with security cameras located in common areas. These cameras are in continuous operation to monitor and record activities with the sole purpose of maintaining a safe environment. We want to assure our guests that the handling of these recordings is carried out with the utmost respect for their privacy and safety.

The recordings obtained by these cameras are exclusively accessible to authorized personnel of ZANTUAR. The recordings are used solely for internal security purposes. Under no circumstances will these recordings be shared with third parties, except in situations where there is a formal request by competent authorities and in compliance with the applicable legislation in force.

 

ZANTUAR commits to responsible handling of the images captured by our security cameras, ensuring that your privacy and safety are our highest priority.

Recordings

 

From time to time, authorized personnel of ZANTUAR will be making recordings inside the facilities of ZANTUAR. Such recordings will be used solely for advertising purposes of ZANTUAR. Therefore, by this instrument, the Guest revocably authorizes ZANTUAR to use their image, face, and/or voice in such recordings and for the purposes indicated herein. On the other hand, should the Guest wish to revoke their consent, they must communicate it in writing to the contact methods indicated later.

Non-compliance with Terms and Conditions

In the event that the Guest breaches the content of this instrument, they will be subject to penalties by ZANTUAR, such as the interruption of services by ZANTUAR or expulsion from its facilities. ZANTUAR exclusively reserves the right to sanction Guests who are in breach in the manner and severity it deems appropriate.

Modifications to the Terms and Conditions

ZANTUAR reserves the right to modify these Terms and Conditions at any time. Modifications will become effective immediately after their publication on our official channels or their direct communication with the Guests.

Contact and Complaints

 

For any questions, comments, or complaints related to these T&C or your stay at ZANTUAR, we invite you to reach out to our management through the contacts provided on our website, on third-party platforms such as Airbnb, or via our WhatsApp number, which will be provided once your reservation is made.

 

By accepting these terms, you acknowledge having read, understood, and agreed to be bound by them, committing to respect the entirety of their content during your stay at ZANTUAR.

Privacy Notice for ZANTUAR

This Privacy Notice (hereinafter, the "Privacy Notice") sets forth the characteristics and details of the processing of data and personal information provided by users to ZANTUAR in connection with the lodging services provided by the latter. This Privacy Notice is governed by the legal provisions established in the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter, the "LFPDPPP"). ZANTUAR is located at Calle Morelos, Brisas de Zicatela, C.P. 70934, Oaxaca, Mexico.

Introduction

At ZANTUAR, located in the splendid state of Oaxaca, Mexico, we commit to respecting the privacy of our guests, as well as protecting their personal data with the utmost care and in accordance with the national laws applicable, primarily in compliance with the LFPDPPP. This Privacy Notice aims to provide a clear understanding of how we collect, use, protect, and manage personal data in our possession, provided by our guests and visitors.

Scope of the Privacy Notice

This Privacy Notice applies to all personal data collected by ZANTUAR through our website, direct booking systems, third-party platforms, email communications, phone calls, and any other means used by guests or potential customers; who will also be subject to our Privacy Notice once they have made contact with us through any of our technological communication means to interact with us.

Collection of Personal Data

In accordance with the provisions set forth in Article 15 of the LFPDPPP, ZANTUAR collects information that allows us to provide personalized services and enhance the lodging experience of our guests. In that sense, the personal data collected include, but are not limited to, the person's name, official identification, email address, phone number, payment information, tax information, and stay preferences.

Use of Personal Data

The personal data collected will be used exclusively for the following purposes:

  1. To manage bookings and provide the requested services.

  2. To communicate relevant information about the stay, offers, and promotions from ZANTUAR or any other properties related to our group.

  3. To improve the quality of our services and the guest experience.

Limitation on the Use and/or Disclosure of Personal Data

ZANTUAR commits not to share, sell, rent, transfer, or disclose personal data provided by its guests or clients to unrelated third parties, except in the following cases:

I. Service providers and business partners working with ZANTUAR for the operation of the property and the provision of services, who are also contractually obligated to comply with this Privacy Notice and the applicable laws in force regarding the protection of personal data held by private parties.

II. When required by law, by a judicial order issued by a competent authority, or to respond to legal processes.

III. To protect the rights, property, or safety of ZANTUAR, our guests, or the general public, in accordance with applicable laws.

IV. Data Security

ZANTUAR implements technical, physical, and administrative security measures to protect personal data against unauthorized access, alteration, disclosure, or destruction. However, it is important to recognize that no data transmission over the Internet or electronic storage method is 100% secure.

Limitation of Liability on Third-Party Platforms

Although ZANTUAR exercises due care in selecting third-party platforms and business partners, ZANTUAR is not responsible for the privacy practices or content of external websites. We encourage our guests to read the privacy policies of any third-party platform used.

International Data Transfers

Personal data may be stored and processed in any country where we have operations or where our service providers are located. By providing us with their personal data, guests consent to such transfers.

In addition to the provisions of the previous paragraph, ZANTUAR will not make any other type of transfer of personal data to any third party unrelated to ZANTUAR.

Exercise of "ARCO" Rights by Guests

In accordance with the provisions set forth in the LFPDPPP, guests have the rights of access, rectification, cancellation, and opposition (hereinafter, the "ARCO Rights") regarding the use of personal data provided to ZANTUAR. Any request related to the exercise of the ARCO Rights should be directed to our customer service team, through the following email address reservas@zantuar.com.mx. In the email, the guest who is the holder of the ARCO Rights in question must indicate and specify which right they wish to exercise, as well as their identity; otherwise, the request will not be addressed.

Changes to the Privacy Policy

ZANTUAR reserves the right to modify this document at any time. Modifications will become effective immediately after their publication on our website. In case of changes or modifications to this Privacy Notice, ZANTUAR will notify the holders of the personal data via email, thirty days in advance of the entry into force of such changes or modifications.
